Την κακοποίηση που υφίστανται τα δελφίνια στην αιχμαλωσία (σωματική και ψυχοδιανοητική), αλλά και την έλλειψη κάθε εκπαιδευτικής αξίας των παραστάσεων που πραγματοποιούνται στα δελφινάρια, επισήμανε κατά την παρουσία του στην Αθήνα, τις ημέρες αυτές, ο διάσημος εμπειρογνώμων και πρώην εκπαιδευτής θαλασσίων θηλαστικών, Ρικ Ο'Μπάρι, γνωστός στο ευρύ κοινό από το βραβευμένο με όσκαρ ντοκιμαντέρ The Cove. "Το χαμόγελο των δελφινιών είναι η μεγαλύτερη πλάνη της φύσης. Δημιουργεί την εντύπωση ότι είναι πάντοτε χαρούμενα", δήλωσε για πολλοστή φορά ο θρυλικός υπερασπιστής των δελφινιών. 

Κατά την παραμονή του στην Αθήνα, ο κος Ο'Μπάρι και εκπρόσωποι των διοργανωτών, συναντήθηκαν με τον Υπουργό Περιβάλλοντος και Κλιματικής Αλλαγής, κο Ιωάννη Μανιάτη, ο οποίος, αφού συνομίλησε μαζί τους, εξέφρασε το ενδιαφέρον και την πρόθεσή του να εξετάσει σύντομα την θεσμοθέτηση απαγόρευσης της αιχμαλωσίας δελφινιών και λοιπών κητωδών στην χώρα μας, ακολουθώντας το παράδειγμα άλλων - Ευρωπαϊκών και όχι μόνο - κρατών. 

Στη συνέχεια, ο Αμερικανός ιδρυτής του παγκοσμίου βεληνεκούς προγράμματος Ric O'Barry's Dolphin Project, συμμετείχε σε προγραμματισμένη συγκέντρωση, που διοργανώθηκε από από την ομάδα Dolphin Project Greece και την Πρωτοβουλία Κατά της Αιχμαλωσίας των Κητωδών (Π.Κ.Α.Κ), και πραγματοποιήθηκε στις 24 Ιουνίου, έξω από το Υπουργείο Περιβάλλοντος, με τη συμμετοχή πολιτών και οργανώσεων. 

Την συγκέντρωση τίμησε με την παρουσία του ο χρυσός ολυμπιονίκης του windsurfing, Νίκος Κακλαμανάκης, ο οποίος μάλιστα υποσχέθηκε ότι θα κολλήσει το σύνθημα εναντίον της αιχμαλωσίας των δελφινιών στο πανί του, για να μεταφέρει σε όλον τον κόσμο το μήνυμα ότι τα δελφίνια ανήκουν στη θάλασσα. "Το λιγότερο που μπορώ να πω είναι ότι αξίζει να συμπαραταχθεί κανείς με αυτήν την προσπάθεια, γιατί έχει και υγεία και αλήθεια", δήλωσε στους δημοσιογράφους ο χρυσός ολυμπιονίκης, παγκοσμίως γνωστός και σαν "Γιός του Ανέμου". "Η ευαισθητοποίηση για ηλικιωμένους, παιδιά, άτομα με ειδικές ανάγκες αλλά και για τα ζώα, μπορεί να δείξει το επίπεδο του πολιτισμού μας. Το σπουδαιότερα απ' όλα είναι ότι η Ελλάδα μπορεί να παράγει πολιτισμό. Αξίζει να προσπαθήσουμε!", τόνισε ο Νίκος Κακλαμανάκης.

Στο τέλος της εκδήλωσης, η οποία τελικά μετατράπηκε σε γιορτή, ο Ρικ Ο’Μπάρι και ο Νίκος Κακλαμανάκης παρέδωσαν στον υπουργό του ΥΠΕΚΑ, κο Ιωάννη Μανιάτη, εκ μέρους των διοργανωτών, ευχαριστήρια επιστολή για την υπόσχεσή του να επιληφθεί του θέματος. Όπως αναφέρεται στην επιστολή, "η απαγόρευση της αιχμαλωσίας των κητωδών είναι σύμφωνη με τις τελευταίες επιστημονικές απόψεις που επισημαίνουν την ιδιαιτερότητα αυτών των θαλασσίων θηλαστικών, και εναρμονίζεται με τις απαιτήσεις του σύχρονου πολιτισμένου κόσμου για την ηθική μεταχείριση των ζώων και την ορθή περιβαλλοντική εκπαίδευση. Οι αρχαίοι Έλληνες αντιμετώπιζαν τα δελφίνια ως πλάσματα ισότιμα με τους ανθρώπους, τα ονόμαζαν 'λαό της θάλασσας', και προέβλεπαν την ποινή του θανάτου για εκείνους που τα κακοποιούσαν. Σήμερα, η Ελλάδα οφείλει όχι μόνον να συμμετέχει αλλά και να πρωτοστατήσει στην παγκόσμια προσπάθεια που θέλει να θέσει τέλος στην εκμετάλλευση και τον εγκλεισμό τους στα δελφινάρια".  

Επιστολή, υπογεγραμμένη από τους διοργανωτές, εστάλη και στον υπουργό του ΥΠΑΑΤ, κο Γεώργιο Καρασμάνη, με αίτημα την συνεργασία για την άμεση συμπλήρωση του νομοθετικού πλαισίου, έτσι ώστε να σταματήσουν οι παραστάσεις με δελφίνια, οι οποίες εκθέτουν την Ελληνική πολιτεία στους πολίτες της, και ολόκληρη την χώρα μας στο εξωτερικό. "Έχουμε ενημερώσει το υπουργείο σας για τη συνεχιζόμενη παραβίαση της νομοθεσίας, και έχουμε επισημάνει κάποια κενά στο νομοθετικό πλαίσιο, τα οποία δεν επιτρέπουν την εφαρμογή του νόμου", επισημαίνεται στην επιστολή. 

Την επομένη της εκδήλωσης, ο Ρικ Ο'Μπάρι έφυγε για Θεσσαλονίκη, από όπου θα μεταβεί στις Βρυξέλλες για να παραστεί, στις 28 Ιουνίου, στην πανευρωπαϊκή διαμαρτυρία που διοργανώνεται από την πρωτοβουλία "For a Dolphinarium-free Belgium" (Pour une Belgique sans delphinarium) και υποστηρίζεται από διάφορες Ευρωπαϊκές οργανώσεις, για δεύτερη συνεχή χρονιά, με αίτημα όχι μόνον την παύση της λειτουργίας του τελευταίου δελφιναρίου που υπάρχει στο Βέλγιο, αλλά και την απαγόρευση όλων των δελφιναρίων σε όλες τις χώρες της Ευρώπης. Η είδηση της υπόσχεσης του κου Μανιάτη να εξετάσει την απαγόρευση διατήρησης των κητωδών σε αιχμαλωσία στην χώρα μας έγινε δεκτή με ενθουσιασμό, κάνει ήδη τον γύρο του διαδικτύου, και έχει αναρτηθεί σε σελίδες κοινωνικής δικτύωσης με εκατοντάδες χιλιάδες μέλη από ολόκληρο τον κόσμο, αποσπώντας θετικά σχόλια και ευχαριστείες. SPECIAL EVENTS HIGHLIGHT DOLPHIN CAPTIVITY ISSUES IN GREECE

• Sunday June 22^nd, 5 PM: The Poseidonion Grand Hotel, Spetses

Special screening of the Oscar-winning documentary THE COVE, followed at 6:30 PM by a special Q & A session with Ric O’Barry, star of The Cove, and other speakers. The event is FREE, sponsored by the Wildlife Cooperative in cooperation with the Dolphin Project-Greece. The Cove depicts the slaughter of dolphins in Taiji, Japan, and documents the connection to the international captive dolphin trade. 

• Tuesday, June 24^th, 10 AM to 12PM: Rally  with Ric O’Barry in front of Ministry of Environment, March to Ministry of Agriculture -- Address: 119 Mesogeion Avenue, Athens, Greece

The event is free, hosted by Dolphin Project - Greece and Initiative Against Cetacean Captivity (ΠΚΑΚ) and supported by the Panhellenic Animal Welfare and Environmental Federation (ΠΦΠΟ) and the Hellenic Wildlife Hospital (EKΠAZ). 

In January 2014, the Greek Parliament voted in favor of upholding the ban on animal performances.  The Greek Ministry of Agriculture does nothing to enforce the law which prohibits the animal performances, while the Greek Ministry of Environment continues to allow the keeping of dolphins in captivity.

We are asking the Greek Government to enforce the law and stop the dolphin shows, and most importantly to ban cetacean captivity in Greece. We will also be presenting to the Minister a petition with over 7000 signatures, asking for the ban of captivity in Greece.

In short, the protesters are asking for:  
1) enforcement of the law, 
2) a total ban of dolphin captivity in Greece. 

Dolphins are intelligent, wide-ranging mammals swimming between 60-100 km a day in the wild. These sentient beings suffer in captivity from confinement and separation from their family pod,  dumped into a small concrete tank (only a few meters in length and depth) with strangers and forced to do "shows" through food deprivation. Recent scientific research confirms that keeping dolphins in captivity is physically and mentally detrimental to these animals. Dolphins born in captivity don't stop being wild animals after a few generations, therefore they suffer equally. In addition, dolphins born in captivity are not releasable and their only use is to preserve the captive population where they live out the rest of their days in shallow chlorinated pools performing tricks for food.

INITIATIVE AGAINST CETACEAN CAPTIVITY: Who we are and what we stand for

PEOPLE OF THE SEA BORN TO BE FREE!

The Facebook page Stop Attica Zoological Park Dolphinarium (Athens - Greece) was started by citizens who are against captivity of cetaceans. It was founded in 2011 as the English counterpart of the Facebook group ΟΧΙ ΣΤΟ ΔΕΛΦΙΝΑΡΙΟ-ΤΣΙΡΚΟ ΣΤΟ ΑΤΤΙΚΟ ΠΑΡΚΟ. It’s prime directive is to achieve better networking within Greek and international circles. We are not a specific animal protection organization nor are we a part of a political party. We are an independent group of people with interests in nature, ecology, animals and their well-being. We do however; collaborate with various animal protection groups within Greece and abroad and various political parties as well as activist groups that defend Animal Welfare or/and Animal Rights, always within the letter of the law.

Our group stays informed by following scientific research conducted on both wild and captive cetaceans, and hence we are up to date on current research and re evaluate our position according to new findings. One of our goals is to pass this information on to the public.

Over the past few years, cetacean captivity has become the object of public debate. Startling revelations by trainers have brought to light what really occurs behind the scenes in dolphinariums worldwide. In addition, we now have scientific evidence that confirms that these species are extremely intelligence and have a complex social structure. There are many difficulties that arise from an artificial environment, and consequently even the best infrastructures fail to provide the necessary conditions that are required for their well being. As the neuroscientist Dr. Lori Marino (i) Emory university states "it  is not necessarily the fault of the keepers who work with these animals and are certainly not out to mistreat them. These parks provide good veterinary care. The problem is that cetaceans just cannot take captivity".

By following the work of famous scientists and researchers like Jane Goodall, Naomi Rose, Ingrid Visser, Jean-Michel Cousteau and others who had the opportunity to study certain species of wild animals in their natural habitat, we have learned that for the cetaceans (and some other species such as elephants) family, social structure and means of communication are the cornerstone of their existence. Scientifically acclaimed behavioral scientist Lori Marino has demonstrated that the cetacean brain has complex cognitive functions as well as self awareness equal to that of the human. This scientific fact alone, condemns the use of these animals for entertainment and for captive study purposes.
 
Keeping dolphins in captivity and trading them from one country to another does not conform to scientific ethics and morals. Their high mortality rates and their continuous use in shows in front of an uniformed public do not advocate for educational nor scientific value. In captivity, these amazing creatures who have not lost their wild nature simply by being born in a tank, are obligated to spend their life trapped in a closed environment, deprived of sounds and stimuli found in the open sea. Dolphins in captivity primarily suffer from sense deprivation and this is stressful by itself. They are forced to obey and perform tricks in order to secure their food. They are also forced to procreate (usually with artificial insemination like cows and other farm animals) in order to provide new individuals destined to spend their whole life as captives.

Greece has never in it’s whole history made profit by exploiting dolphins and it’s not a coincidence that the ancient Greeks treated dolphins as equals, they called them "people of the sea" and had the death penalty for those who abused them.

In June 2010, while the rest of the civilized world was denouncing this type of "entertainment", a French businessman created the first dolphinarium in Spata, Attika, Greece. We are not against specific people or businesses, however, we are against conditions that contradict the ethical treatment of animals. As the world wide famous Ric O'Barry, who is known for defending the freedom of dolphins, says in the documentary "A Fall From Freedom", "we are not a bunch of anarchists trying to close down these marine parks. Our strategy is to revolutionize them. There are many marine mammals that have become victims to pollution and nets and so forth, and they become stranded. Well, we need to take them off the beach and take them to these places, rehabilitate them there, and let them go. That should be the show. That’s the show. Not reducing them to performing circus clowns and selling this as education and research". We accept this position as well as those of others distinguished scientists and groups that are fighting for culture, nature and life and for a modern and civilized way of environmental education for the public. This modern and humane method of education is especially important for children, who deserve to be taught from their younger years responsibility and not complacency, to co- exist with other earthlings and not the conventional domination seen in a dolphinarium.

As a nation who loves dolphins and respects them, even having an ancient Greek law that made it illegal to hurt or kill them, it is offensive and disgraceful to have captive dolphins in our country. The time has come to ban cetacean captivity now, in Greece and beyond.

Ric O'Barry is coming to Greece to speak out against the dolphins that are captive in the Attica Zoological Park. On June 22nd, he will be screening the Oscar winning movie "The Cove" and then answering questions. This will be held at the Poseidonion Grand Hotel in Spétses, Greece , from 5-9 pm. On June 24th, from 10 am till noon, there will be a demonstration in front of the Ministry of Environment. Please raise your voice and join Ric in taking a stance against captivity

ANIMALS IN ENTERTAINMENT

• Article 12: Ban of use of any animal to every kind of entertaining shows, events and other relevant activities

1. It is prohibited to retain any kind of animal in the circus or in a circus with a varied program, if these animals are used in any way and for any purpose in their program, they take part in shows, or parades, or appear in front of the public.

2. It shall be prohibited to retain any kind of animal in recreational games, car racing platforms, musical concerts, exhibitions, fairs or other artistic or entertaining festivities/events, where animals are used in whatever way for whichever purpose in their program.

3. Fish rearing, education/training and use of animals for any kind of fights shall be prohibited as well as the rearing and use of dogs and cats for fur, skin or meat for the manufacture of medicinal or other substances.

• Article 13: Exceptions

1. Out of the prohibitions laid down in article 12, paragraphs 1 and 2, the following institutions are excluded: legally operating zoos, aquariums, pet shops, care centers of species of wild fauna and game breeding facilities, governed by special provisions, provided that no shows involving animals are taking place in the aforementioned locations.

2. The provisions of article 12 (shall) apply taking into account article 7, as well as taking into account special provisions relating to racing horse and horse racing.

Όσοι ασχολείστε με την φροντίδα και τα δικαιώματα ζώων κάθε είδους θα πρέπει να γνωρίζετε ότι οποιασδήποτε μορφής κακοποίηση για ΟΛΑ τα ζώα και όχι μόνον για τα ζώα συντροφιάς καλύπτεται από τον νόμο 4039/2012 και τα άρθρα 46 και 47 του νόμου 4235/2014 που διαδέχτηκαν τον νόμο 3170/2003. Η κακοποίηση ΚΑΘΕ ΕΙΔΟΥΣ ΖΩΟΥ καλύπτεται από έναν άλλο νόμο που ψηφίστηκε πριν από 33 χρόνια, τον 1197/1981. Οποιαδήποτε κακοποίηση, κακομεταχείριση ή και θανάτωση ζώου αποτελεί αυτεπάγγελτο αδίκημα.
